1. Overview

These Terms of Service (“Terms”) govern your access to and use of WeatherPower websites, apps, bots, APIs, and any other services that link to these Terms (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility & Accounts

You may use the Services only if you can form a binding contract with WeatherPower and are not barred from doing so under applicable law.

• Account registration: Some features may require an account. You agree to provide accurate information and keep it updated.
• Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• Notification: You agree to notify us promptly of any unauthorized access or suspected security issue related to your account.

3. Use of the Services

Subject to these Terms, WeatherPower grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services for your own personal, non-commercial use (or internal use, if you are an organization), unless we agree otherwise in writing.

You agree not to:

• Use the Services for any unlawful purpose or in violation of any law.
• Interfere with or disrupt the integrity, security, or performance of the Services or the data contained within them.
• Attempt to access the Services or related systems by automated scraping, reverse engineering, or other unauthorized methods.
• Use the Services to send spam, abusive content, or harmful code (such as malware or viruses).
• Misrepresent your identity or affiliation when using the Services.

4. Weather & Safety Disclaimer

WeatherPower provides weather data, radar, alerts, and other information for informational purposes only.

• No guarantee of accuracy: Weather data comes from third-party sources and systems that may experience delays, errors, or interruptions. We do not guarantee the accuracy, completeness, or timeliness of any information.
• Safety decisions: You are solely responsible for decisions you make based on the information provided by the Services, including travel, property, and personal safety decisions.
• Official sources: Always follow instructions and guidance from official agencies (such as local emergency management, the National Weather Service, or equivalent authorities in your region) for critical weather and safety information.

5. Third-Party Services & Links

The Services may integrate with or link to third-party services, including data providers, map platforms, voice tools, analytics tools, and others.

• WeatherPower is not responsible for the content, terms, or privacy practices of third-party services.
• Your use of third-party services is governed by their own terms and policies, not these Terms.

6. Paid & Optional Features

WeatherPower may offer optional paid features, subscriptions, or premium plans. If you purchase any paid Services:

• You agree to pay all applicable fees and taxes in accordance with the pricing and payment terms presented at the time of purchase.
• We may change prices or introduce new charges from time to time, with reasonable notice where required by law.
• Unless otherwise stated, fees are non-refundable except as required by law or expressly stated in an applicable refund policy.

7. Intellectual Property

The Services, including all content, features, and functionality (such as text, graphics, logos, icons, UI design, and software), are owned by WeatherPower or its licensors and are protected by copyright, trademark, and other laws.

• You may not copy, modify, distribute, sell, or lease any part of the Services, nor reverse engineer or attempt to extract the source code, except where applicable law permits or we give you written permission.
• WeatherPower names, logos, and associated marks are trademarks or service marks of WeatherPower. You may not use them without our prior written consent.

8. User Content

Some features of the Services may allow you to submit content (such as notes, custom alerts, messages to WeBot, feedback, or other materials).

• You retain ownership of your content, but you grant WeatherPower a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and create derivative works of your content solely for operating, improving, and providing the Services.
• You are responsible for the content you submit and represent that you have all necessary rights to share it.
• You agree not to submit content that is unlawful, abusive, harmful, or infringes the rights of others.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe:

• You have violated these Terms or applicable law;
• Your use poses a risk to the security or operation of the Services;
• We are required to do so by law or due to changes in the Services.

You may stop using the Services at any time and may request that we delete your account consistent with our Privacy Policy.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Without limiting the foregoing, WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any information provided will be accurate or complete.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WEATHERPOWER OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Services;
• Any errors, inaccuracies, or omissions in weather data or other content;
• Any unauthorized access to or use of our systems;
• Any interruptions or cessation of transmission to or from the Services.

To the extent any liability cannot be excluded, our total liability for any claim arising out of or relating to the Services will be limited to the amount you paid (if any) to use the Services during the twelve (12) months prior to the event giving rise to the claim, or a minimum amount allowed by applicable law.

12. Changes to the Services & These Terms

We may modify, suspend, or discontinue all or part of the Services at any time, including adding or removing features.

We may also update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. If changes are material, we may provide additional notice (for example, in the app or via email).

Your continued use of the Services after the updated Terms become effective means you agree to the revised Terms.

13. Governing Law

To the extent permitted by law, these Terms and any disputes arising out of or relating to them or the Services will be governed by the laws applicable in your region, without regard to conflict-of-law principles. Local mandatory consumer protection laws may give you additional rights.
